Terms and Conditions
Article 1- General Information
Airport Startup Day is an event that aims to encourage development of digital technologies (including web sites, mobile apps and smart phone apps) for simplifying life in terms of aviation and airports operations. Airport Startup Day (“StartupDay”) is a competition; as is defined under Article 2; that concers students, designers, developers, entrepreneurs and marketers for developing services and applications for aviation and related areas.
Article 2- Organisation of StartupDay
Tav Airports Holding is the organizer (“Organizer”) of Startup Day.
Companies shall apply as a team from the Organizer’s web site at the following URL address http://airportstartupday.com (the “Website”) by filling the application form. All applications shall be evaluated by the Organizer and the teams that the Organizer finds eligible shall be invited to StartupDay.
Article 3- Information About Application
To take place in StartupDay the participants must register by filling the form online on the Website by 15 September 2023 23:59 o’clock (İstanbul, TURKEY time).
Organiser reserves the right to change/extend the dates of application.
StartupDay is open to all individuals (“Participants”) who are at least 18 years old at the time of the registration to StartupDay.
Employees of the Organiser or of any of its subsidiary or related companies, their employees and first degree relatives are not eligible to take part in StartupDay.
With completion of registration to StartupDay, the participants accept the Terms and Conditions hereunder.
Following the applicants completion of registration, an e-mail of approval shall be send to the applicants e-mail address provided during the registration. Organizer is not responsible for the applications take place after the final date of registry for StartupDay.
The participants are responsible for the information they provided during the application. The wrong or inadequate data shall be subject to cancellation of application by the Organizer.
All rejections by the Organizer is the sole and final decision of the Organizer.
Any wrong or inadequate personal data or address of the participant may cause the annulment of the registry and/or the award.
To be able to take place in StartupDay the application must be approved by the Organizer. The Organizer shall send a StartupDay Application Information e-mail for applications accepted. Organizer shall have the right to not to approve the application for any reason.
The Organizer is not liable for the interpretation and application of these terms and conditions or responsing to the applicants questions.
The schedule for StartupDay is on the website, detailed information shall be provided for the applicants who are invited to StartupDay.
All applicants shall use their own personal computers and other necessary equipment during StartupDay. The internet connection shall be provided by the Organiser. The Organizer may provide some equipment and clothing for the applicants during StartupDay. The applicants admit that all these equipment and clothing provided by the Organiser are the property of the Organizer.
Travel and accommodation expenses of the 2 Startups that are selected to participate in the Paris Startupday will be covered by the Organiser. All costs for Izmir StartupDay, including without limitation all transport costs, accommodation and other related costs incurred by the participants as a result of and/or pursuant to their participation in StartupDay shall be solely borne by the participants. The Organiser shall not be under any obligation to reimburse the participants for any such costs and expenses incurred thereof.
Article 4- Projects and Intellactual Property Rights
StartupDay is just and equitable event. All participants admit to obey this principle and accept that any action that restrain other teams from their work is forbidden. The Organizer has the right to disqualify the team or the participant who disobeys these principles.
The participants represent and warrant that (i) the project is their original work presented by them during this StartupDay, (ii) the project does not violate or infringe the intellectual property, proprietary or other rights of any third party, (iii) third party intellectual property rights are clearly identified by the participants as well as the applicable terms of license and other details relating to use of same (iv) they possess and control all rights necessary to submit the application irrevocably and without restriction to the Organiser, and (v) that publication of the application via various media including web posting, will not infringe on the rights of any third party.
The participants acknowledge and agree that the Organiser do not have now, nor shall they have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright or other intellectual property right in or to the participants’ project.
Each participant unconditionally agrees that the Organiser has exclusive rights and ownership on each material or document that is provided by the Organiser. The provision of such document/equipment shall not be interpreted as a transfer of right or a granting of ownership, or a granting of intellectual and industrial property right; neither explicitly nor implicitly.
Each applicant grants the Organizer to copy, reproduce, distribute and record any recording and video recording (film or digital) in any format from the beginning of application to StartupDay for unlimited time.
Article 5- Scoring of Entries
A panel of people to be chosen by the Organizer with relevant expertise will be responsible for judging Entries.
The winners of StartupDay will be announced the latest by 15 October 2023 on the Website.
Judges reserve the right to disqualify/not award any or all teams and/or applicants if the team or an applicant does not comply with these terms and conditions and/or found not eligible according to the criteria of StartupDay.
The Entries will be judged according but not limited to the following criteria:
* the value for the customer
* suitable for the themes
* applicablity
* practical implementation
* originality/creativity;
* analytical skills
Determination of eligibility and compliance is at the sole discretion of judges and neither of the applicants has the right to appeal againts the judges’s decisions.
Aricle 6- Prizes
Awarding process will be announced on the website prior to the event.
All the award winning projects and teams will be announced on the Website.
After the Startup Day, none of the Prizes shall be subject to a dispute, change and/or exchange by any reason.
The Organizer shall have the right to change the prizes with an equivalent other one.
Article 7- Confidentiality
For registration to StartupDay the participants shall share their names, surnames, work addresses, phone numbers and emails with the Organizer through registering from the Website.
Each applicant accepts to provide the above mentioned personal information to be able to be able to take place in StartupDay. In case the applicant does not want to share his personal information the registration will not be able to be completed.
The personal information provided during application shall only be used and accessed by the Organiser or of any of its subsidiary or related companies.
Following the completion of StartupDay all the personal data that was registered but not selected eligible shall be deleted from the system. The personal data of the applicants that are found eligible for StartupDay and/or award winner shall be kept by the Organizer for necessary time to be detected by the Organizer.
Article 8- Liabilities of the Participants
The Organiser reserves the right to take action for the teams and/or participants who commit to fraud, cheat or act offensive.
Each team shall take the prior written consent of the Organizer for sharing or marketing of their project for 3 years starting from award ceremony. In case the Organizer give notice in writing to the participant/team concerning that it is not interested to that specific project, the participant/team shall the has the right to share its project with other third parties.
The participants acknowledge that all information shared during StartupDay is publicly known and not subject to confidentiality.
The Organizer reserves the right to request any additional document from the participants.
Article 9 – The Limitation of Liability of the Organizer
The Organizer shall have the right to change the scope, change the time, extend the time, limit the time, change the place or totally cancel StartupDay in case of an unforeseen event takes place.
The Organizer shall not be liable for any viruses or other harmful program that causes damage at the participants’ pc or any other equipment.
Each participant shall be responsible for the equipment and other personal materials that he brought to StartupDay. The Organizer is not responsible for the theft, damage or lost of any such kind of personal equipment of any participant.
All participants accept that the Organizer is not liable for any death, personal damage or injury that takes place during StartupDay.
The Organizer shall not be responsible for the electronic records. Therefore the Organizer shall not be liable for any electronic record that is not recorded properly concerning the registration process.
Organizer warrants the participants against any disconnections of internet and power cuts to be faced. Each participants are solely responsible for his internet connection.
Article 10- Acceptation of the Terms and Conditions of StartupDay- Presentation
Completion of registration to StartupDay shall mean all terms and conditions hereunder are accepted unconditionally by all participants.
These terms and conditions shall be on Website by the end of 17 October 2023.
The Organizer shall reserves the change, cancel or amend any term or condition and publish on the Website before StartupDay. In case there is any conflict between these terms and conditions and the changes/amendments the changed/amended provisions shall prevail. The participant who does not accept the amended/changed provisions shall either quit by himself or become disqualified from StartupDay by the Organizer.
Article 11- Severability
If any term or provision of under these terms and conditions is held to be invalid, illegal or unenforceable, the validity, legality or enforceability of the remaining provisions shall in no way be affected or impaired thereby, and the participants shall substitute for the affected portion an enforceable provision(s) which most closely approximates the intent and the economic effect thereof.
These terms and conditions have also been announced/published in Turkish. The authentic version is the Turkish one. In the event of any conflict between the English and the Turkish version, the Turkish version shall prevail.
